Lawyers for estate purposes

By: articlewritingexpertise

If you intend to own real estate property in Toronto or the larger part of Canada, it is imperative that you understand how real estate law applies in the area. There are differences in how commercial real estate sales are conducted as compared to residential real estate sales. The land transfer rules for a new home vary depending on who is buying. First time buyers of new homes enjoy a tax refund, which applies to single buyers, newly married couples and non-spousal partnership purchase. First time buyers of resale homes too will enjoy a tax rebate. One must have the relevant documentation to claim a refund including the Land Transfer Tax Refund affidavit form, the transfer duly registered, the sale agreement, copy of the statement of adjustments made at the completion of sale and purchase and a New Home Warranty Certificate.

Title insurance is issued to the purchaser or the real estate lawyer representing him or her. The insurance covers the state of the ownership at the time of purchase. This document is very important as it provides ownership protection for the buyer, against losses that may occur due to problems in the title. It also protects the purchaser against frauds and forgeries. Other loopholes that are taken care of by title insurance are unpaid property taxes by the previous owner, solicitor error and omissions, survey errors, encroachments, defects in the title, invalidity, liens and contravention of subdivision, development or other agreements among others.

If you intend to include another person on the title of your newly acquired or long existing real estate property, you may request for a title transfer. A title transfer may also change the existing names completely when ownership is being transferred or deleting a person’s name. One is required to present a written submission with the necessary instruction. Your Real Estate Law office will then prepare the necessary documentation. Signatures of the affected persons will be required and the new title will have to be registered.

When choosing a real estate lawyer, ensure that they are specialists in real estate law and that they have the requisite knowledge and necessary experience to handle the job. Get your quote for the cost of the transaction, including all the legal fees. You do not want an invoice for something you were not aware of in the first place. If you are buying property in another state, you might want to give your lawyer power of attorney authorizing him/her to represent you in most of the required purchase procedures; unless you do not mind traveling back and forth. This is why you need to choose your real estate lawyer with caution. It might seem logical to get one from your locality because you know him/her better, but remember you need a practitioner who understands how Real Estate Law Toronto works.

With a little research, you can find the appropriate law firm or independent lawyer to help you in the deal. Check their reviews and credibility record before signing up for their services. They should also appear in the Toronto Real Estate list of licensed lawyers.
